The Decree has introduced the discipline of the administrative responsibility of the companies (Standards governing the administrative liability of legal entities, companies and associations including those without Legal Personality, according to art. 11 of law no. 300 of 29 September 2000).
According to such regulations, the companies can be held responsible and subsequently suffer economic sanctions, for certain offences that are either committed or attempted in the interest or to the advantage of the company itself by its directors or shareholders or employees.
Companies can adopt Organization, Management and Control Models to prevent these crimes (“Model”); models whose principles can be found in the Code of Conduct (guidelines) established by the trade Associations.
This is the path taken by S.P.L. Industries SRL: the company is exonerated from the above mentioned administrative liability if it is shown that its organizational, management and control model (231 Model), adopted on July 10, 2015 following the CDA deliberation, is able to prevent the execution of the criminal offences referred to.
